Trump, Sharia, Millet – טראמפ, שריעה, מילט

הלילה פירסם דונלד טראמפ את תכניתו למלחמה בטרור, שאשכרה נשמעת די הגיונית. טראמפ מתכוון למנוע כניסה לארצות הברית לאנשים שלא עומדים במבחנים האידיאולוגיים הבאים:

* תומכי ארגוני טרור;

*מי שמאמין בקנאות ובשנאה;

* מי שאינו מאמין בחוקת ארה"ב;

* מי שתומך בחוקי השריעה;

* מי שלא סביר להניח ש"ישגשג בארה"ב";

* ומי שלא יאמץ את ערכיה של ארה"ב.

סך הכל לטראמפ יש בעיות בחמש קטגוריות מתוך השש. האם הוא 'משגשג בארצות הברית'? זה עניין של נקודת זמן נתונה. טראמפ הוא שיאן פשיטות הרגל בארצות הברית בשלושים השנה האחרונות. אבל עכשיו הוא באיזה סוג של פיק ברכבת ההרים הזו, כך ש'משגשג' זה כנראה עניין יחסי.

 האם הוא תומך בערכיה של ארצות הברית? ודאי לא באלו המתבטאים בשירה של אמה לזרוס "הקולוסוס החדש", החקוק על פסל החירות –

Give me your tired, your poor,

Your huddled masses yearning to breathe free,

The wretched refuse of your teeming shore.

Send these, the homeless, tempest-tost to me,

I lift my lamp beside the golden door! 

ספק עד כמה לזרוס עצמה הייתה עומדת בתנאיו של טרמפ להגירה. הדונלד טראמפים של אמצע המאה ה-19  לא הסתכלו בעין אוהדת על גלי ההגירה ממזרח אירופה, שכללו גם כמות אדירה של יהודים (שהצילה אותם מהשואה ויצרה את הנוכחות הבולטת של יהודים בציבוריות האמריקאית החיונית כל כך לקיומה של מדינת ישראל) ועקרונית היו מעדיפים להשאיר אותם קצת בחוץ. מה שמוביל אותנו ישירות לשלושת התנאים הראשונים – תמיכה בטרור, קנאות ושנאה ודחיית חוקת ארצות הברית. אלו תנאים מוזרים ממי שזוכה לברכתם של שני אירגונים העומדים בתנאים אלו באופן מזהיר – המפלגה הנאצית האמריקאית ואירגון הקו קלוקס קלאן.

מה שמשאיר לנו את השריעה. השריעה היא ההלכה המוסלמית. כל מוסלמי המתפלל חמש פעמים ביום, מעיד על אמונתו באללה, תורם לצדקה, מבצע את מצוות החאג'וצם ברמד'אן, תומך ב'חוקי השריעה'. אבל כמו שיטות משפט דתיות אחרות, כמו ההלכה, המדובר במערכת חוקים סבוכה, ובהקשר הפוליטי גם נותנת מרשם לניהול יחידה פוליטית ששונה במשהו מזה שטראמפ, או החוקה האמריקאית, היו תומכים בו. כך, למשל, אוסרת השריעה (וגם ההלכה) על תשלום ריבית, המנוע של השיטה הקפיטליסטית האמריקאית.

ועם כל זאת, יש מדינה אחת קטנה במזרח התיכון, בה נהוגים חוקי השריעה לגבי אזרחיה הרבה מעבר למתבקש מקיום בסיסי של מצוות הדת. ודווקא בפן מאוד בעייתי של מערכת חוקית זו, מערכת דיני המשפחה של השריעה – אלו הפטריארכליים, הדורשים אפוטרופסות לאישה מבוגרת, או מבדילים בין גברים ונשים בזכות הירושה. זו כמובן מדינת ישראל, שבשיטה הנהוגה בה בדיני משפחה מונהגת השריעה כפי שהיא מפורשת על פי האסכולה המשפטית החאנפית, כדין האישי – הנכפה על ידי המדינה – של חלק ניכר מאזרחיה. במובן זה כל אזרח ישראלי התומך בהמשך שיטת המילט 'תומך בשריעה'.

נראה שהקמפיין של טראמפ קצת כושל בארצות הברית. לא נורא, פיגוע גדול אחד והוא על הסוס שוב, עם שנאת זרים ומוסלמים. ככה זה עובד, אצלנו לפחות. אצלנו הוא לא צריך לחכות. הציבור שלנו קונה כבר שנים את ביבי, רק בגלל שהוא משדר את אותו סוג של גזענות זחוחה. ובאמת התבשרנו אתמול שטראמפ פתח את הקמפיין הישראלי שלו בקניון במודיעין.  שיהיה בסבבה. רוב הבוחרים האמריקאים היהודים שאני מכיר שחיים כאן בארץ ושומרים על זכות הבחירה דווקא משדרים איזה סוג של סלידה מהולה בפחד מהאיש, אבל אם מחפשים מצבור של מוחות חלולים לשטוף בגזענות עבור רווח פוליטי, בלי לשפוט לחומרה יותר מדי את תושבי מודיעין, ואת אלו מביניהם שהם אזרחים אמריקאים, הייתי אומר שהקניון שם הוא מקום טוב להתחיל בו כמו כל מקום אחר בארצנו.

משהו אישי קטן – אבלה את השבועיים האחרונים של ספטמבר בארצות הברית. טיול לפני גיוס של אלמוג. זמן לא רע לביקור ראשון (הייתם מאמינים? בן חמישים עוד מעט) ממש לפני הבחירות. אולי אכתוב משם קצת יותר. בימים האחרונים אני כותב כאן הרבה פחות בגלל עומס של עניינים ועומס החום, והבלוג ירד לשיאים שליליים של צפייה. מהסיבה הזו גם לא יינתן ממתק. שניים שלושה פוסטים אחרונים זכו למספרים מדאיגים ברמה השלילית של קוראים, ואני מאמין שהעוקבים אחרי בטוויטר ובפייסבוק פשוט חשבו שאני משתף שיר בגלל המנגנון הלא חכם של פירסום בוורדפרס שמקשר ליוטיוב במקום לפוסט הזה. בקיצקיצור – היו שלום. ותחזיקו מעמד בימים המשונים האמורים להגיע אחרי נובמבר.

Tonight Donald Trump has published his plan to fight terrorism, which actually sounds quite logical. Trump intends to prevent entry to the United States of people who match the following ideological criteria:

* Supporters of terrorist groups;

* Supporters biggotry and hatred;

* Those who do not believe in the United States Constitution;

* Those who  believe Sharia law should supplant American law;

* Those Who are not likely to flosurish in the United States ";

*  Those who do not accept the values of the United States.

It seems Trump himself may have problems in five categories out of six. Did he "flourish in the United States?" It's all a matter of a given point in time. Trump is the record holder of bankruptcies in the United States in the last thirty years. But now he is in some kind of peak point on this roller coaster, so 'flourishing', is probably a matter of perspective.

Does he accept the values of the United States? Certainly not those expressed in Emma Lazarus's poem "The New Colossus" inscribed on the Statue of Liberty –

Give me your tired, your poor,

I Doubt if Lazarus herself would comply with the Trump conditions of immigration. The Donald Trumps of the mid-19th century did not look favorably on immigration from Eastern Europe, which also included a vast amount of Jews (thus saved from the Holocaust and created the prominence of Jews in the US public sphere so essential for the existence of the State of Israel) and in principle they would prefer to leave them outside. Which leads us directly to the first three conditions – support for terrorism, fanaticism and hatred and rejection of the Constitution of the United States. These are strange conditions for a candidate who managed to win the endorsement of the Nazi party of the United states and the Grand wizard of the KKK. But hey, we have one more condition – no one would blame Trump for following the Sharia.

Sharia is Islamic religious law. Every Muslim who prays five times a day, testifies as to his faith in Allah, makes charitable contributions, thrives to visit Mekka (Haj), and fasts on the holy month of Rammadan – follows Sharia laws. But like other religious legal systems, such as Hallakha, the Jewish law, it is a complex and rich system of religious code that can be implemented in all aspects of life, and the Sharia's political context also gives prescription to manage political affairs in a somewhat different manner than Trump or the US Constitution would prescribe. Thus, for example, the Sharia (and Hallakha) forbid the payment of interest, which is the engine of the American economic system.

Nevertheless, there is one small country in the Middle East, in which Sharia law is enforced way beyond enabling Muslim citizens to practice the basics of their religion. And actually in a very troublesome aspect of its legal system, family law, to its full patriachal aspects- requiring male guardianship of any adult woman or differentiating between men and women regarding the right of inheritance. This is of course the State of Israel, implying the Sharia (in the way of the Hannafi legal school) as part of its millet system. Sharia is thus the personal law of all Israeli Muslim citizens, enforced in all matters of personal status. In this sense, every Israeli citizen supporting the current system of family law – the Ottoman millet system, actually endorses Sharia.

Trump's campaign seems a bit lagging behind in the US. Never mind, one big terrorist attack and he is riding high again on a wave of  xenophobia and hatred of Muslims. This is how it works, at least for us. In Israel he has no need to wait. Our public votes Bibi for decades, just because he conveys the same kind of smug racism. Indeed we were told yesterday that Trump opened his Israeli campaign in a Modiin mall, hoping to get votes of US citizens living in Israel, apparantly some 200,000 eligible voters.  Most US citizens living in Israel I know speak of Trump in a kind of revulsion mixed with fear, but if one looks for a stash of hollow brains to wash with racism for political gains, not disregarding the good people of Modiin I would say the mall there is a as good a place to start as any other in our country.
